Welcome to Wick & Spark. These Terms of Service govern your access to and use of www.wickandspark.com, including browsing our website, purchasing products, creating an account, contacting us, or using any services offered through the website.

By accessing our website or placing an order, you agree to these Terms of Service, our Return, Refund & Shipping Policy, and our Privacy Policy. If you do not agree, please do not use the website or place an order.

2. Products and services

Wick & Spark sells handmade home-fragrance products and related items, which may include candles, wax melts, candle accessories, custom scent design, corporate gifting, event candle bars, and other products or services.

Product offerings, prices, descriptions, sizes, weights, photos, packaging, colors, scents, and availability may change at any time without notice.

We reserve the right to discontinue any product or service at any time.

3. Handmade product disclaimer

Wick & Spark products are handmade and hand-poured in the USA in small batches. Because of this, each item may vary slightly.

You understand and agree that minor variations are normal and are not defects, including but not limited to:

  • Product color

  • Wax finish

  • Surface texture

  • Frosting, wet spots, air bubbles, small cracks, or other common soy wax characteristics

  • Decorative details

  • Vessel appearance

  • Label placement

  • Product photos compared with actual product

  • Scent strength or scent perception

  • Approximate product weight

Product images are for reference only. We try to display colors and products accurately, but we do not guarantee that your screen display will accurately reflect the actual product.

4. Product weight

All product weights are approximate. For 3-wick candles, the approximate net weight is:

16.4 oz / 465 g

Other product weights will be listed on product pages as available. Because each product is handmade and hand-poured, small weight variations may occur and are not considered defects.

5. Fragrance and sensitivity disclaimer

Our products may contain fragrance oils, soy wax, dyes, decorative materials, and other candle-making ingredients.

Fragrance experience varies from person to person and depends on room size, ventilation, temperature, burn habits, warmer type, and personal sensitivity.

Wick & Spark does not guarantee that any scent will meet a particular fragrance preference or scent-strength expectation.

Do not use our products if you are allergic or sensitive to candles, wax melts, fragrance oils, smoke, soy, dyes, or related ingredients. Discontinue use immediately if irritation, headache, breathing discomfort, allergic reaction, or other sensitivity occurs.

Our products are not intended to diagnose, treat, cure, or prevent any disease or condition.

6. Candle and wax melt safety

You are responsible for using all Wick & Spark products safely and as directed.

For candles:

  • Trim wick to approximately 1/4 inch before each burn.

  • Burn only on a stable, level, heat-resistant surface.

  • Keep away from drafts, children, pets, curtains, bedding, books, paper, furniture, and anything flammable.

  • Never leave a burning candle unattended.

  • Do not burn for longer than recommended on the product label or care instructions.

  • Stop use when approximately 1/2 inch of wax remains.

  • Do not move a burning candle or a candle with hot wax.

  • Allow the vessel to cool before handling.

For wax melts:

  • Use only with an approved wax warmer.

  • Do not add water.

  • Do not melt on a stovetop or in an unapproved device.

  • Do not ingest.

  • Keep away from children and pets.

  • Follow the warmer manufacturer’s instructions.

For electric candle lighters or accessories:

  • Follow all product instructions.

  • Keep away from children and pets.

  • Use only as intended.

  • Do not use damaged accessories.

Failure to follow safety instructions may result in fire, injury, property damage, smoke damage, burns, or other harm. Wick & Spark is not responsible for damage or injury caused by misuse, unsafe use, improper handling, failure to follow instructions, or use of products in a manner not intended.

The CPSC identifies candle fire-safety labeling and related ASTM candle standards as relevant candle safety standards, so you should keep clear candle warning labels and safety instructions on your products and pages.

7. Orders

By placing an order, you represent that:

  • All information you provide is accurate and complete.

  • You are authorized to use the payment method provided.

  • You have reviewed the product description, price, shipping information, and policies before purchasing.

  • You understand all sales are final.

  • You understand handmade products may vary.

We reserve the right to accept, decline, cancel, limit, or refuse any order for any reason, including suspected fraud, pricing errors, inventory issues, product unavailability, shipping restrictions, payment issues, or violation of these Terms.

If we cancel an order after payment has been processed, we will issue any required refund to the original payment method.

8. Pricing and availability

Prices are listed in U.S. dollars unless otherwise stated.

We reserve the right to change prices, correct errors, update products, modify descriptions, or discontinue products at any time.

We do our best to keep product information accurate, but mistakes may occur. We are not required to honor pricing, typographical, image, inventory, or description errors.

9. Payment

Payment is due at the time of purchase.

Payment processing may be handled by third-party payment processors. By submitting payment information, you agree that your information may be processed by those third-party providers according to their own terms and privacy policies.

We do not guarantee that all payment methods will be available at all times.

10. Processing and shipping

All orders are handmade, hand-poured, inspected, and packed with care.

Please allow approximately 2–5 business days for order processing before shipment. This processing time does not include carrier transit time.

Shipping times are estimates only and are not guaranteed unless expressly stated in writing. Wick & Spark is not responsible for carrier delays, weather delays, holiday delays, incorrect routing, lost packages, stolen packages, delivery disruptions, or other shipping issues outside our control.

Customers are responsible for providing a complete and accurate shipping address.

11. Returns, refunds, and cancellations

All sales are final.

We do not accept returns, exchanges, cancellations, or refunds except where required by law or where Wick & Spark determines, in its discretion, that an item arrived damaged, defective, or incorrect.

Our Return, Refund & Shipping Policy is incorporated into these Terms by reference.

12. Custom orders, bulk orders, corporate gifting, and events

Custom orders, custom scent design, corporate gifting, event candle bars, bulk orders, personalized products, and special projects may require separate written terms, deposits, payment schedules, timelines, and approvals.

Unless otherwise stated in writing, all custom, event, corporate, bulk, and personalized orders are final sale and non-refundable.

Custom timelines are estimates and may depend on supply availability, approval timing, order quantity, shipping carrier performance, and other factors.

13. Account information

If you create an account on our website, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate, current, and complete information and to update your information when necessary.

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or appear to be used fraudulently.

14. Promotions and discounts

Promotions, discounts, coupon codes, free-shipping offers, and special offers may be changed, limited, or discontinued at any time.

Promotions cannot be applied retroactively unless we state otherwise. Only one discount may apply per order unless otherwise stated.

Sale, promotional, clearance, and discounted items are final sale.

15. Intellectual property

All content on this website, including text, product names, product descriptions, photos, graphics, logos, designs, packaging concepts, branding, and website content, is owned by or licensed to Wick & Spark unless otherwise stated.

You may not copy, reproduce, distribute, modify, publish, sell, or use our content for commercial purposes without written permission from Wick & Spark.

16. User submissions

If you submit reviews, photos, testimonials, messages, comments, social media tags, or other content to Wick & Spark, you grant Wick & Spark permission to use, repost, display, edit, and share that content for marketing, advertising, website, social media, and business purposes, unless prohibited by law.

You agree that any content you submit will not violate the rights of others, contain false information, or include unlawful, abusive, obscene, defamatory, or harmful material.

17. Third-party links and services

We are not responsible for third-party websites, policies, content, actions, errors, security practices, or services. Your use of third-party services is at your own risk and may be governed by the terms and policies of those third parties.

To the fullest extent permitted by law, Wick & Spark is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost revenue, lost data, personal inconvenience, emotional distress, shipping delays, carrier errors, product misuse, property damage from improper use, or dissatisfaction with scent preference.

To the fullest extent permitted by law, Wick & Spark’s total liability for any claim related to an order will not exceed the amount paid by the customer for the product giving rise to the claim.

Some states do not allow certain limitations of liability, so some limitations may not apply to you.

21. Indemnification

You agree to indemnify, defend, and hold harmless Wick & Spark and its owners, employees, contractors, service providers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from your misuse of the website, misuse of products, violation of these Terms, violation of law, or violation of the rights of another person or entity.

22. Force majeure

Wick & Spark is not responsible for delays or failure to perform caused by events beyond our reasonable control, including severe weather, natural disasters, supply shortages, labor disruptions, shipping carrier delays, power outages, internet outages, equipment failure, illness, government action, emergencies, or other events outside our control.
